]]>This became apparent when Diran Zacharan (24) appeared at Cape Town Magistrate’s Court on Friday last week for dealing in dagga.
“Zacharan was arrested in Table view by the Hawks led multidisciplinary team during a disruptive operation undertaken by the team on Thursday,” said Hawks spokesperson, Captain Philani Nkwalase.
“A third and fully operational hydroponic dagga lab was uncovered with a total of 95 dagga plants worth R95 000 in Table view, Cape Town.”
This follows after two others that were dismantled at small holding farm in Mikpunt Klipheuwel and in Palm Beach Harbour Island last December and February respectively.
Capt Nkwalase said that Zacharan was arrested at his Table view premises for the allegedly dealing in dagga connected to the operating and cultivating hydroponic dagga lab.
“Furthermore, over R20 000 cash notes was also recovered during the search and seizure at the suspects’ residence.”
The case against Zacharan was postponed to 23 May for further investigation whilst he was released on R2000 bail.

]]>“Sokaba was arrested during in a disruptive operation on the N2, in Sedgefield, on his ways to George from the Eastern Cape,” said Hawks spokesperson, Captain Philani Nkwalase.
The Hawks led an integrated team that included SAPS crime intelligence, the Langeberg K9 Unit and Eden Cluster Combating Team in the bust.
“He was driving a hired vehicle which was found loaded with about 472 kg of dagga, contained in 17 bags, valued around R900 500,” Capt Nkwalase said.
“He appeared briefly at the Knysna Magistrate’s Court and was incarcerated pending his next appearance on the 13 March 2019.”

]]>“Members immediately reacted on the information,” explained police spokesperson, Captain FC Van Wyk.
“Upon their arrival at the address, they searched the shop and found one .38 Special Revolver with 28 rounds, one 9mm pistol, two parcels of dagga and 140 sachets of dagga.”
He said the police officers arrested two suspects, aged 18 and 24, on illegal possession of unlicensed firearms and ammunition and possession of drugs.
“Both suspects will appear in the Wynberg Magistrates Court on Friday on the mentioned charges.”

]]>“They were arrested with three unlicensed firearms and drugs valued at R2 129 950,” police spokesperson, Lieutenant Colonel Andrè Traut.
“At around 15:30 the AGU members responded to a tipoff about drugs at a residence in Oasis squatter camp, Philippi.
They conducted a search operation, which led to the discovery of two 9mm pistols, a .45 calibre pistol, 70 rounds of ammunition, dagga valued at R1 million and heroin with a street value of R129 950-00.
He said six cellphones and R11 550-00 cash, believed to be the proceeds of drug trafficking were also confiscated.
“The six suspects, aged between 23 and 35, are due to make a court appearance on Thursday. They face charges of the possession of unlicensed firearms and ammunition and dealing in drugs.”
The Provincial Commissioner of the Western Cape, Lt Gen KE Jula, praised his members for the valuable contribution in beating the scourge of gang-related crime ahead of the festive season.
He also encouraged the community to continue with their assistance by providing us with information about criminality.

]]>The media has been awash with reports (sometimes conflicting, often vague) of what the recent Constitutional Court ruling actually means in practice.
Whether you agree with the ruling or not, and whether or not you personally have ever had (or intend to have) anything to do with cannabis/marijuana/weed/dagga, we all need to be aware of the implications.
Here’s some food for thought –
o To use or be in possession of cannabis in private for his or her personal consumption in private; and
o To cultivate cannabis in a private place for his or her personal consumption in private.
Any form of supply or purchase, even in private, and any possession or use by a minor (under 18), anywhere, would still put you at risk of a criminal record and heavy penalties.
There is also no clarity on what will be considered to be a “private place” other than the Court’s comment that there are places other than “a person’s home or a private dwelling” where the right to privacy would apply.
The bottom line – you still risk arrest on suspicion of having or growing more dagga than a police officer considers reasonable for your personal consumption, or in a place that you consider “private” but that a police officer doesn’t.
Employers: a final note
Having a properly-drawn “sobriety policy” in place will reduce the risk of confusion and dispute in the workplace. If you have a policy in place already, ask your lawyer to check that it adequately covers you in light of these new developments.
